Privacy Policy

Acceptance of Terms

By using this website, you are hereby accepting the terms and conditions stipulated within this Agreement. If you are not in agreement with our terms and conditions, then you should refrain from further use of our website. In addition, your continued use of our website following the posting of any updates or changes to our terms and conditions shall mean that you agree and accept such changes.

The Association for Commuter Transportation (ACT) collects certain information from an individual and/or an organization when individuals and/or organizations:

·    Register as a member via the ACT website.

·    Subscribes to receive emails and/or newsletters from ACT.

·    Register for the use of ACT’s online communities or post information on shared areas of ACT’s website, and/or apps.

·    Purchases certain products or services from ACT.

·    Register for ACT events, webinars, discussions, or other similar activities.

·    Submit an email or request additional information about membership, events, policies, or other topics.

·    Respond to surveys gathering information on their organization, programs, services, and products.

·    Participate in ACT sponsored research initiatives.

ACT also collects certain publicly available information from public sources such as social media (for example Twitter or LinkedIn) and company websites.

What information does ACT collect?

Member Contact Information: We will collect personal information that you provide to us, including, but not limited to, your name, designation(s), employer’s name, job title, mailing address(es), e-mail address(es), telephone number(s), fax number, and photograph(s). Such information is used to facilitate your access to, use of, purchase of, or participation in our service and product offerings, including, but not limited to: membership; events, meetings, or conferences; educational programs; and online forums. Please note that you may decline to share your personal information with us, in which case we may not be able to provide you with certain aspects of our services or products.

Member Background Information: We will collect background information that you provide to us, including, but not limited to, personal demographics, biography, primary job role, job history, education, areas of interest, social media handles, honors and awards. Such information is collected to analyze member background and improve the member experience.

Payment Information: If you choose to purchase a registration, membership, product or service, we and/or our third-party payment processors will collect your payment information, including, but not limited to, your credit or debit card number, card verification value (CVV) number, and expiration date.

Enrollment, Registration, and Order Form Information: In order to enroll in or register for an ACT program, attend ACT events, meetings, or conferences, or request ACT products or services, you will be required to fill out a registration or order form and provide personal information, which we will use to process your registration or order. In certain circumstances, a program, event, meeting, or conference accessed through the ACT website (the “Site”) may be jointly sponsored or co-sponsored with another organization. If the enrollment or registration is handled by such other organization, that organization’s (not ACT’s) privacy policy will apply and be controlling relative to the information collected. Please note that ACT is not responsible for the privacy policies of such other organizations or their collection, use, sharing, or other processing of your personal or other information, and ACT hereby disclaims any liability or responsibility in connection therewith.

Program Information: ACT may collect information specific to the characteristics, impacts, benefits, and scope of the programs and services that you offer.  This may include participation data, ridership data, mode split data, vehicle miles traveled, program costs, air quality data, and other similar information used by transportation demand management programs to measure their performance.

Behavioral Information:  ACT collects information on how you use the Site and interact with email communications, including links clicked and pages visited.

Automated Information: Your web browser or mobile device automatically provides information when you visit the Site, including, but not limited to, your Internet Protocol (IP) address or unique device identifier.

Cookies: Cookies are pieces of stored information on a user’s computer or device that are tied to information about the user and used to provide smoother navigation throughout the Site, such as to store a saved password; to identify user trends, such as page views; and for other internal purposes, such as to assess the effectiveness of the Site. You have the option of setting your computer to disable cookies or to alert you when cookies are being used. If you choose to disable cookies, please be aware that portions of the Site may not function properly.

How does ACT use the information?

To fulfill our obligations. ACT uses personal contact information you share with us to fulfill contractual obligations that may include providing products or services that you or your organization purchased, answer your contract administration related inquiries or communicate with you via email about your account or transactions with us, and send you information about features on the Site, or changes to our policies or events for which you registered.  Individuals may request to be unsubscribed from email communications, except for emails regarding financial transactions and payment reminders.

To perform research.  ACT may use collected information to aggregate member data, schedule interviews or conduct surveys.  If an individual or organization is to be identified by name, separate approval from you will be sought. 

To improve research, the website and measure effectiveness. ACT regularly analyzes data pertaining to visitor trends, research consumption, and research grading to improve our research, plan site enhancements, measure overall site effectiveness and the effectiveness of e-mail campaigns.

To maintain a secure Site. IP addresses are collected in order to maintain our Site security and ensure access to restricted portions of the Site is limited to authorized users.

To improve our performance by using third party vendors. We may also disclose certain data to third party contractors or vendors in connection with their performance of services to us. Contractual agreements between us and such third parties provide that your information will be kept confidential and secure.

To market our products and services.  ACT may use business contact information obtained directly from you or from third party sources to send marketing emails and other communications in order to promote our products and services.

To conduct ACT Events.  ACT may make available a third-party mobile application during certain events for engagement and networking purposes. When registering for those events you may choose to have your name, company and title be available to event attendees on the mobile application. ACT also uses a third-party virtual event platform for virtual events and some live events. Your name, company and title will be displayed on ACT’s third-party virtual event platform and will be available to other event attendees in the same way your name, company and title is displayed on your badge during a live event. ACT transfers certain information of event registrants and attendees to its event sponsors. For details on how ACT shares your information with sponsors, please see below:

  • Pre/Post Event List. Dependent on level, some sponsors of an ACT event are provided a “Pre and/or Post Event List” for marketing & promotion purposes. The list contains name, job title, organization name and email registered for the event.
  • Opt-out Pre/Post Event List. During registration, you will have an opportunity to opt-out of receiving communications from sponsors related to the event.
  • Event Exhibitors: ACT event attendees may be provided with badges having bar codes that may be scanned at sponsored activities or exhibit booths. Attendee contact information (first name, last name, title, company, email, work phone, work address, work state, work zip code, country) is transferred to any exhibitor that scans the badge.
  • Virtual Events: When visiting a sponsor’s virtual space in the Event’s platform, the sponsor is able to see your name, title, and company in real-time. If you download information or view anything in the sponsor’s virtual space, then your contact information (first name, last name, title, company, email, work phone, work address, work state, work zip code, country) is transferred to the sponsor in real-time for the sponsor’s use in marketing.

How long does ACT keep my information?

ACT retains your personal information for as long as necessary to fulfill the purposes for which it was collected as set forth in this policy, after which we will securely destroy or delete such personal information from our records unless otherwise required by law. We will retain and use information as necessary to comply with legal obligations, resolve disputes, enforce agreements, and as otherwise set forth in this privacy policy.

Who else might ACT share my data with?

ACT may transfer your information to our chapters, councils, committees, or third parties in order to facilitate the activities of the organization.  Whenever your personal information is transferred, stored, or processed by us, we will take reasonable steps to safeguard the privacy of your personal information.

Children’s Policy

We do not knowingly collect personal information as defined by the U.S. Children’s Privacy Protection Act (“COPPA”) from children under 13. We encourage parents and guardians to take an active role in their children’s online activities and interests. If you are a parent or guardian and believe we have collected information in a manner not permitted by COPPA, please contact us at 202-792-5801 and we will remove such information to the extent required by COPPA. We also do not knowingly “sell” the personal information of minors under 16 who are California residents without their affirmative authorization.

What responsibility do I have?

While we do our best to protect your personal information, we cannot guarantee the security of any information that you transmit to us and you are solely responsible for maintaining the secrecy of any passwords or other account information. In addition, other Internet sites or services that may be accessible through our Site, such as by links to a third party website, and those other Internet sites or services may be subject to separate data and privacy practices independent of us, and therefore we disclaim any responsibility or liability for their policies or actions. Change to Privacy Policy:

We reserve the right to update this Privacy Policy format any time. If we make changes, we will revise this Privacy Policy to reflect such changes and revise the effective date included at the beginning of this policy. We may provide you additional notice (such as to your e-mail address) if the changes are material. Your use of the service or product or Site following any change will signify and constitute your assent to and acceptance of such revised Privacy Policy.   Please regularly review this Privacy Policy so that you are aware of its contents.
