HR 409 - Supporting Transit Commutes Act

Why Important to ACT: Transit subsidies are a transformative commuter benefit that improves access to jobs and removes barriers to sustainable transportation. When employers offer them, it’s a win for workers and a win for our communities' mobility. Our workforce, businesses, and environment all stand to gain if tax deductibility is restored.

HR 3936/S. 2023 - Bicycle Commuter Act of 2025
Sponsor: Senator Peter Welch, (D-VT), Senator Alex Padilla (D-CA), and Congressman Mike Thompson (D-CA-4)
Why Important to ACT: This bill reestablishes pre-tax commuter benefits for individuals who bike to work, while also allowing those benefits to be used in conjunction with other commuter tax benefits including parking, transit, and vanpooling. Importantly, the legislation expands eligibility to include electric bicycles and bike or scooter share programs, recognizing the evolving landscape of micromobility options.

Federal Aviation Administration Reauthorization

Why Important to ACT: Like Transportation Authorization, FAA Rauthorization must be passed on average every 5 years. The bill includes important legislative changes related to the financing and development of airport capital projects and workforce development issues. ACT believes there are opportunities through the FAA Reauthorization to encourage airports to take on greater responsibility for how passengers and airport workers access airport facilities, and that they should support the deployment of TDM strategies to improve access and reduce airport related carbon emissions.

HR 3473 - Bicycle Commuter Act

Why Important to ACT: The Bicycle Commuter Act would provide commuters with a pre-tax benefit of $81/month for riding their bike to work. This benefit could be used in addition to the pre-tax benefit for public transit/vanpool ridership.

HR 3145 - People Over Parking Act

Why Important to ACT: The People Over Parking Act would would eliminate outdated parking minimum requirements for new affordable residential, retail, industrial or commercial construction .

HR 2514 - Mobility Options, Resiliency, and Efficienty through Transportation Demand Management Act (MORE Through TDM Act)
Sponsor: Rep. Jesus "Chuy" Garcia, (D-IL-4)
Why Important to ACT: The MORE Through TDM Act was developed with input from ACT. The legislation includes the codification of a definition of TDM and TDM Strategies; the development of a new TDM program; and the creation of a University Transportation Center focused on TDM.

HR 8555 - Parking Cash Out Bill

Why Important to ACT: This legislation would stipulate that a parking benefit is not a qualified parking fringe benefit unless an employer offers employees the option to receive an equivalent cash benefit or alternative tax-exempt benefit in lieu of the parking benefit.

HR 7900 - National Defense Authorization Act for Fiscal Year 2023

Why Important to ACT: ACT was able to work closely with members of the Armed Services Committee to introduce ACT's endorsed definition of TDM as an Amendment within the NDAA. This would codify the definition of TDM at the federal level.

HR 5376 - Inflation Reduction Act of 2022

Why Important to ACT: This legislation represents the country's greatest action and largest investment in combatting climate change. The legislation provides new tax credits for the purchase of commercial clean vehicles, including buses; provides $27 billion for a Greenhouse Gas Reduction Fund; and provides $3.2 billion to establish a Neighborhood Access and Equity Grant program, whose funds can be used to improve walkability, safety, and affordable transportation access.

Federal Programs & Funding
The Infrastructure Investment and Jobs Act (IIJA), signed into law on November 15, 2021, reauthorizes federal surface transportation programs for the following five years. IIJA includes funding to rebuild and reinvest in our public transit infrastructure, and the safety of our transportation system and invest billions in TDM programs.
In addition to the continuation of formula funding programs like Congestion Mitigation & Air Quality (CMAQ) Program, IIJA provides funding through a wide range of competitive grant programs. Opportunities to apply for the grant programs are noticed by the U.S. Department of Transportation (USDOT) through Notice of Funding Opportunities (NOFO).
